These Terms of Service (“Terms”) govern your use of the Tottoms LLC website at tottoms.com and any related services, products, or events (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Tottoms LLC (“Tottoms,” “we,” “us,” or “our”) is a Florida limited liability company headquartered in New Port Richey, FL.

1. Eligibility

You must be at least 18 years old to create an account, make a purchase, or enter into these Terms. Minors may use the Services only with the involvement of a parent or legal guardian who agrees to these Terms on their behalf. By using the Services, you represent that you meet these requirements.

2. Account Registration

To access certain features, you may need to create an account. You agree to:

Provide accurate and complete information when registering
Keep your password secure and not share it with others
Notify us immediately at support@tottoms.com if you suspect unauthorized use of your account
Take responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

3. Products and Orders

Pricing and Availability

All prices are listed in U.S. dollars. We reserve the right to change prices at any time without prior notice. Product availability is not guaranteed, and we may limit quantities or discontinue products at our discretion.

Order Acceptance

Placing an order constitutes an offer to purchase. We reserve the right to refuse or cancel any order for any reason, including pricing errors, suspected fraud, or product unavailability. If we cancel your order after payment, we will issue a full refund.

Payment

We accept major credit cards and other payment methods shown at checkout. Payment is processed securely through our payment provider. You represent that you are authorized to use the payment method provided.

Shipping and Delivery

Estimated shipping times are provided at checkout and are not guaranteed. Risk of loss and title for products pass to you upon delivery to the carrier. We are not responsible for delays caused by carriers, customs, or events outside our control.

Returns and Refunds

Our return and refund policy is available at tottoms.com/policies/refund-policy and is incorporated into these Terms by reference. Please review it before purchasing.

4. Electric Go-Kart Products — Safety and Compliance

Tottoms sells electric go-kart conversion kits, complete karts, and related components. By purchasing and using these products, you acknowledge and agree to the following:

You are responsible for ensuring that your use of our products complies with all applicable federal, state, and local laws, including traffic regulations and vehicle codes.
Electric go-karts and conversion kits are intended for off-road or closed-course recreational use only unless explicitly stated otherwise. Operation on public roads may be illegal in your jurisdiction.
You assume all risk associated with the installation, modification, and operation of our products.
Proper safety equipment, including helmets and protective gear, should be used at all times during operation.
Modifications to our products beyond intended use may void any applicable warranty and may create safety hazards. Tottoms is not liable for injuries or damage resulting from improper installation or unauthorized modifications.
Products should only be installed and operated by individuals with appropriate mechanical knowledge or under qualified supervision.

These terms apply in addition to any product-specific warnings, instructions, or documentation included with your purchase.

5. Events and Ride Experiences

Participation

Attendance at Tottoms-hosted events is subject to availability and may require advance registration. We reserve the right to refuse entry or remove any participant who violates event rules, poses a safety risk, or behaves in a disruptive manner.

Liability Waiver

All event participants are required to sign a liability waiver before riding. Participation by minors requires a parent or legal guardian to sign on their behalf. By signing the waiver, participants acknowledge the inherent risks of riding electric go-karts and release Tottoms from liability for injuries arising from those risks.

Queue and Ride Management

Ride queue position is managed at our discretion. We do not guarantee a specific wait time or number of rides. Participants who do not respond to queue notifications within a reasonable time may forfeit their spot.

SMS Notifications at Events

When you provide your phone number at an event check-in and opt in to SMS, you will receive queue notifications. Message and data rates may apply. Reply STOP to opt out at any time. See our Privacy Policy for full details on how we handle SMS communications.

6. Intellectual Property

All content on tottoms.com — including text, images, videos, logos, product designs, and software — is owned by or licensed to Tottoms LLC and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, display, or create derivative works from any of our content without prior written permission. You may share links to our site and use our content for personal, non-commercial reference only.

7. User Conduct

When using the Services, you agree not to:

Violate any applicable law or regulation
Submit false, misleading, or fraudulent information
Attempt to gain unauthorized access to any part of our systems or accounts
Interfere with the operation of the Services or servers
Use the Services to transmit spam, malware, or harmful content
Scrape, crawl, or extract data from our site without permission
Post defamatory, harassing, or offensive content in reviews or public areas

We reserve the right to remove content and suspend or terminate access for violations of this section.

THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the site will be uninterrupted, error-free, or free of viruses. We do not warrant that product descriptions or pricing are accurate, complete, or current, though we make reasonable efforts to ensure accuracy.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TOTTOMS LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 90 DAYS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Tottoms LLC and its officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) the installation or operation of our products.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Pasco County, Florida, and you consent to the jurisdiction of those courts.

Before initiating any legal action, you agree to contact us at support@tottoms.com and attempt to resolve the dispute informally for at least 30 days.

13. Changes to These Terms

We may update these Terms at any time. When we do, we will post the revised Terms on this page and update the “Last updated” date. If changes are material, we will make reasonable efforts to notify you (e.g., by email or a notice on our site). Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice. Upon termination, your right to use the Services ceases immediately. Sections 6, 9, 10, 11, and 12 survive any termination of these Terms.

15. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy and any product-specific terms, constitute the entire agreement between you and Tottoms regarding the Services.
Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.
Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights freely.
No Third-Party Beneficiaries: These Terms do not create any rights for third parties.
