Tottoms LLC — Participant Release of Liability, Waiver of Claims, and Indemnity Agreement

In consideration of being permitted to participate in electric go-kart (Crazy Cart) activities operated by Tottoms LLC ("Company"), I, the undersigned participant (or parent/guardian signing on behalf of a minor), acknowledge and agree to the following:

1. ASSUMPTION OF RISK. I understand that participation in electric go-kart (Crazy Cart) activities involves inherent risks, dangers, and hazards including but not limited to: collisions with other riders or barriers, loss of vehicle control, falls, physical injury, head injury, broken bones, and property damage. I acknowledge that these risks exist even when safety equipment is used and all rules are followed. I voluntarily and knowingly assume all such risks, both known and unknown.

2. RELEASE OF LIABILITY. I hereby release, waive, discharge, and covenant not to sue Tottoms LLC, its owners, officers, directors, employees, agents, volunteers, sponsors, and event venue owners/operators (collectively "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury — including death — that may be sustained by me while participating in this activity, whether caused by the negligence of the Released Parties or otherwise.

3. INDEMNIFICATION. I agree to indemnify, defend, and hold harmless the Released Parties from any loss, liability, damage, costs, or expenses (including reasonable attorney's fees) that they may incur as a result of any claim brought by me or on my behalf arising from my participation in this activity.

4. MEDICAL AUTHORIZATION. In the event of an emergency, I authorize the Released Parties to seek and consent to medical treatment on my behalf. I accept full financial responsibility for any medical expenses incurred. I represent that I am in sufficient physical condition to safely participate and am not aware of any medical condition that would prevent my safe participation.

5. RULES & SAFETY COMPLIANCE. I agree to follow all safety rules, instructions, and guidelines provided by Tottoms LLC staff at all times. I agree to wear all required safety equipment, including a helmet, while operating a Crazy Cart. I understand that failure to comply may result in immediate removal from the activity without refund.

6. PHOTO & VIDEO RELEASE. I grant Tottoms LLC and its authorized representatives the irrevocable right to photograph, film, record, and use my likeness, image, voice, and appearance for any lawful purpose including marketing, advertising, social media, and promotional materials, without compensation. I waive any right to inspect or approve the finished materials.

7. AGE ACKNOWLEDGMENT & MINOR PARTICIPANTS. By signing below, I confirm that I am 18 years of age or older, OR that I am the parent or legal guardian of the minor participant named in this form and have the legal authority to execute this waiver on their behalf. I understand that this waiver is fully binding on the minor participant and their heirs.

8. SEVERABILITY. If any provision of this agreement is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

9. GOVERNING LAW & JURISDICTION. This agreement shall be governed by and construed in accordance with the laws of the state in which the event takes place. I agree to submit to the personal jurisdiction of the courts of that state for resolution of any disputes.

10. ENTIRE AGREEMENT. This document constitutes the entire agreement between the parties. I acknowledge that I have read this agreement in its entirety, that I understand its terms, and that I am signing it freely and voluntarily.

This waiver shall be binding upon myself, my heirs, executors, personal representatives, and assigns.
